Misuse of lift truck could result in $112,000 fine

The Occupational Safety and Health Administration (OSHA) has proposed penalties of $112,500 to Manhattan Beer Distributors LLC after an investigation in May 1998 uncovered nine violations of OSHA standards.The investigation was fueled after an employee complained of unsafe working conditions. According to OSHA area director Anthony J. DeSiervi, "Our investigation disclosed that employees routinely were elevated using a lift truck-either standing on a pallet being lifted on the tines, or directly on the tines.''
The largest increment of the total fine is for an alleged willful violation totalling $55,000. A willful violation is an intentional disregard for, or plain indifference to, the requirements of the OSHA act and regulations.

Manhattan Beer Distributors did not respond to questions from Modern Materials Handling.
The employer, located in Wyandanch, N.Y., was also cited for four alleged repeat violations carrying proposed penalties of $45,000 for 1) failure to have permanent aisles or passageways appropriately marked, 2) failure to have a written hazard communication program, 3) failure to have a place of employment that was clean and orderly, and 4) failure to provide training to lift truck operators.
Manhattan Beer was previously cited for these violations in October 1997 at its location in the Bronx.
